Two to Four Family Units:
If one or more units are used for non-residential purposes (office, day care, retail, etc.) the building must be rated as "Non-Residential".
Other Residential Buildings:
Incidental occupancies are permitted in Other Residential buildings (5 units or more) if the total area of the incidental occupancy (office, day care, retail, etc.) is less than 25% of the total floor area. Otherwise the building is rated as "Non-Residential".
Example:
A 10-unit apartment building with one unit used as an office and a second unit used as a day care center is rated as "Other Residential".
A 10-unit apartment building with two units used as office space and one unit used as a day care center is rated as "Non-Residential".
Non-Residential Buildings
Non-Residential Buildings containing residential occupancies are rated as "Non-Residential".
